These Terms & Conditions (“Terms”) govern your use of the ShootSmart mobile application (“ShootSmart,” “the app,” “we,” “us”). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use ShootSmart. You are responsible for using the app in compliance with all applicable laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use ShootSmart for your own lawful, personal use, subject to these Terms and the applicable app-store terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
ShootSmart offers optional paid features (“Premium”). Purchases and subscriptions are billed through the Apple App Store or Google Play and are subject to their terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store or Google Play account settings. Except where required by law, payments are non-refundable and are handled according to the applicable app store’s refund policy.
You retain ownership of the content you create in the app, including scores, notes, and target photos. You grant us a limited license to host, store, and process that content solely to operate and provide the app. You are responsible for the content you submit and represent that you have the right to submit it.
You agree not to misuse the app, including by attempting to reverse engineer it, disrupt its operation, access it through unauthorized means, or use it for any unlawful purpose.
ShootSmart is a training and scoring aid only. It is not a substitute for professional firearms instruction, and it does not make you safe. You are solely responsible for the safe handling, storage, transport, and use of firearms and ammunition, and for complying with all applicable federal, state, and local laws and range rules. Always follow established firearm safety rules at all times. We are not responsible for any injury, damage, or loss resulting from firearm use or from your use of the app.
Automatic target detection and scoring, including any photo-based or timer-based features, are provided on a best-effort basis and may be inaccurate or incomplete. Results are for your personal reference and training only and should be independently verified. We do not warrant the accuracy of any score, hit detection, time, or analysis.
The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the app, your content, or your violation of these Terms or applicable law.
We may suspend or terminate your access to the app at any time if you violate these Terms. You may stop using the app and delete your account at any time.
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, through in-app notice. Continued use of the app after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to its conflict-of-laws rules.
